1. What this service is / 这是什么服务
We host real-estate listings and 3D/VR tours for real-estate agents, and provide tools to capture, edit and share them. Using the site or the PlaceVR app means you accept these terms.
我们为地产经纪托管房源与 3D/VR 看房,并提供采集、编辑、分享的工具。使用本站或 PlaceVR App 即表示接受本条款。
2. Your account / 你的账号
You are responsible for what happens under your account. Keep your password (or your Apple/Google sign-in) to yourself. Tell us immediately if you think someone else has access.
账号下发生的事由你负责。请保管好密码(或 Apple/Google 登录方式)。怀疑被他人使用,请立即告知我们。
3. Who owns your content / 内容归属
Photos, panoramas, floor plans and listing text you upload to a listing in your own account remain yours. You grant us the permission we need to store, process and display them in order to run the service (including generating VR tours and sharing links you create). You confirm you have the right to upload what you upload — including permission to photograph the property.
你在自己账号下的房源里上传的照片、全景、户型图与文字仍然属于你。你授予我们为提供服务所必需的存储、处理与展示许可 (包括生成 VR 和你自己创建的分享链接)。你需确认你有权上传这些内容 —— 包括拍摄该房产的许可。
Listings that belong to a company account. Once a listing has been assigned to a company account, that listing and its content — photos, panoramas, floor plans, listing text, VR tours and capture data, including anything added later — belong to that company account on this service, and stay with the company if you leave it. When you leave, the listing is handed to another member of the company; it is not deleted and does not move back to your own account. For content you add to such a listing, you grant the company a non-exclusive, royalty-free, perpetual licence to keep using, editing and publishing it for that listing. This section does not decide who owns the copyright in photos you took — that is up to the law and to any agreement between you and the company. Listings in your own account that have not been assigned to a company stay yours when you join or leave a company. Leaving a company does not remove copies you already have, including capture files saved on your own phone.
归属于公司账号的房源。一套房源一旦被划入某个公司账号,这套房源及其内容 —— 照片、全景、户型图、房源文字、VR 与采集数据,包括之后再加进去的 —— 在本平台上归该公司账号所有;你离开该公司时,它留在公司。你离开时,这套房源会交给公司的另一位成员,不会被删除,也不会回到你自己的账号。对于你加到这类房源里的内容,你授予该公司一项非独占、免费、永久的许可,供其为这套房源继续使用、编辑和发布。本节不决定你所拍照片的版权归谁 —— 那由法律以及你与公司之间的约定决定。你自己账号下、未划入公司的房源,在你加入或离开公司时仍然属于你。离开公司不会清除你手上已有的副本,包括保存在你自己手机里的采集文件。
3a. Authorization to advertise / 对外广告的授权
For any listing that becomes publicly visible through the service, you confirm that you (or your broker) have obtained the property owner's authorization to advertise it. We do not verify that authorization — it is your responsibility as the licensee.
对任何通过本服务对外公开的房源,你确认你(或你的挂靠经纪公司)已取得该房产所有权人对外广告的授权。 我们不核实该授权 —— 作为持牌人,这是你的责任。
3b. Fees, cancellation and refunds / 费用、取消与退款
The terms in this section apply once your company subscribes to a paid plan. Paid plans are sold as company-account subscriptions. The price and billing period are shown to your company before it subscribes, and applicable sales tax is added. A paid subscription renews automatically at the end of each billing period until it is cancelled. You can cancel at any time by emailing info@mylistings.top; cancellation takes effect at the end of the current billing period, and you can keep using the paid features until then. Amounts already paid for the current billing period are not refundable.
本节条款在你的公司开通付费订阅后适用。付费方案按公司账号订阅出售。价格与计费周期会在你的公司开通前向其展示, 并另加适用的销售税。付费订阅在每个计费周期结束时自动续费,直至取消。你可以随时发邮件到 info@mylistings.top 取消 —— 取消在当期结束时生效,当期内可照常使用付费功能。已付费的当期不退款。
If you were already paying for an individual account before company subscriptions became available, your existing arrangement continues on its current terms until its current paid period ends; your account will be set up as a one-person company account and its end date will not change. You will not be charged for a company subscription unless you choose to subscribe.
在公司订阅上线前已按个人账号付费的用户:原有安排按原条件继续,直到当前已付费期结束; 你的账号会转为「一人公司」账号,到期日不变。除非你自己选择开通,我们不会向你收取公司订阅的费用。
4. Acceptable use / 使用规范
Do not upload content you have no right to, do not misrepresent properties, do not use the service to harass anyone, and do not try to access other users' data or break the service.
不得上传你无权上传的内容、不得虚假描述房源、不得用于骚扰他人、不得试图访问他人数据或破坏服务。
5. Service availability / 服务可用性
We are a small team. The service is provided "as is", without warranties. We may change or suspend features, and we do our best to keep data safe — but you should keep your own copies of anything critical.
我们是很小的团队。服务按「现状」提供,不附带任何保证。我们可能调整或暂停功能;我们会尽力保护数据, 但重要资料请你自己也留一份。
6. Liability / 责任限制
To the extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim.
在法律允许的范围内,与本服务有关的任何主张,我们的总责任以你在主张发生前 12 个月内向我们实际支付的金额为限。
7. Ending it / 终止
You can stop using the service at any time and ask us to delete your data (see the Privacy Policy). We may suspend an account that breaks these terms.
你可以随时停止使用并要求删除数据(见隐私政策)。 违反本条款的账号,我们可能暂停。
Deleting your account does not delete the listings you published or the VR tours and share links you created; the licence you granted us in section 3 to host and display them continues for those items after your account is deleted, so that links you have already sent to clients keep working.
删除账号不会删除你已发布的房源,也不会删除你创建的 VR 与分享链接;你在第 3 节授予我们的 托管与展示许可,在账号删除之后对这些内容继续有效,以便你已经发给客户的链接仍然能打开。
8. Governing law / 适用法律
These terms are governed by the laws of the State of New York, USA. / 本条款适用美国纽约州法律。
